Concerns are being raised over new government legislation aimed at curtailing “abusive conversion practices” targeting LGBT individuals. While meant to protect vulnerable groups, critics argue it could have unintended consequences for free speech.

The initiative is intended to outlaw methods allegedly used to change the sexual orientation of LGBT people. However, the Free Speech Union (FSU) and other organizations like Christian Concern argue existing laws already criminalize such practices.

According to the FSU, “Forcing gay people to attempt to become straight is already illegal — so the obvious question is: what, precisely, is Labour proposing to prohibit that is not already prohibited?” This sentiment echoes views from Christian Concern’s Paul Huxley, who points out that practices like electroshock therapy and chemical castration are either illegal or obsolete in the UK.

One of the more contentious points is whether the law could criminalize less extreme actions, such as offering prayers or counseling to those questioning their sexual identity. Conversations between parents and children about gender identity might also be affected.

The FSU warns that the proposed law could hinder “good-faith, exploratory conversations” between medical professionals, parents, and children experiencing gender confusion. It emphasized, “The word ‘abusive’ is doing an enormous amount of work in the bill’s title.”

The organization further stressed that distinguishing between a constructive dialogue and an abusive act will largely depend on the specifics of the legislation and its enforcement. It vowed to closely monitor how these aspects are developed.

Legal experts caution that such a bill could clash with human rights law, as evidenced by the previous Conservative government’s silent withdrawal from a similar initiative due to conflicts with free speech principles.
