In the ongoing debate about marriage laws in the UK, a campaign group is urging a clearer distinction between civil and religious marriage ceremonies. The Coalition for Marriage (C4M) has raised concerns about the legal standing of sharia marriages, arguing that they could lead to a parallel system that undermines current marriage protections.

C4M issued a statement on Wednesday criticizing Minister for Courts Sarah Sackman’s comments in Parliament. Sackman had compared sharia councils to Christian and Jewish faith courts, which C4M argued was misleading. According to C4M, only civil marriages confer legal rights and obligations, and while Christian and Jewish ceremonies are legally integrated, sharia marriages are not unless accompanied by a civil ceremony.

“Stop legitimising private forums as ‘courts’ in official speech,” the coalition stated, emphasizing that there is no legal equivalence with family courts. C4M has called on Sackman to correct her statements in Parliament.

The coalition referenced a government review that warned against recognizing sharia councils as “courts” due to the risk of establishing a separate legal system. They highlighted a case reported by The Times, involving a sharia marriage between a convicted rapist and his 15-year-old victim, to underline the importance of a singular civil law governing marriage.

C4M also addressed controversy over an NHS article discussing the “benefits” of first-cousin marriage, which was retracted following criticism, including from health secretary Wes Streeting. The group criticized the article as part of a broader issue of miscommunication and misinterpretation regarding marriage laws.

To prevent further legal ambiguities, C4M is advocating for mandatory civil marriages to precede or coincide with any religious ceremony, with penalties for non-compliance. They call for eliminating unregistered and child marriages and propose sanctions for officials who facilitate such unions. Additionally, they urge that NHS communications be clear and scientifically grounded regarding consanguinity risks.

“A civil marriage gives both spouses the protections that private ceremonies simply do not,” stated C4M, noting the importance of a unified marriage law in promoting freedom, dignity, and security for all.

However, the proposals have sparked debate, with John Stevens from the Fellowship of Independent Evangelical Churches (FIEC) expressing concerns about potential impacts on religious freedom for various communities. Stevens argued that the measures might restrict the ability to hold non-state-sanctioned marriages even in private.
