In a contentious legal battle highlighting workplace policies around gender identity, Scottish nurse Sandie Peggie is challenging the Royal College of Nursing (RCN) over alleged discrimination. Jennifer Melle, a Christian nurse previously involved in a related dispute, is providing her support in this case.

Peggie’s legal action stems from a refusal by the RCN to assist her after NHS Fife suspended her for objecting to a transgender doctor using female changing facilities. This marks her second tribunal case, following a partial victory against NHS Fife last December.

Her case resonates with earlier disputes involving healthcare professionals. Melle was suspended for refusing to use male pronouns for a transgender patient identifying as female, but later reinstated with “no case to answer” according to the Nursing and Midwifery Council (NMC).

Similarly, the “Darlington Nurses” challenged the use of female changing rooms by a biological male, resulting in an apology and a six-figure payout after a protracted legal fight.

The RCN contends that Peggie’s gender-critical beliefs did not influence their decision not to provide her with legal counsel, asserting that their actions adhered to organizational protocols.

Melle and Bethany Hutchison, President of the Darlington Nursing Union, are set to testify on Peggie’s behalf. Melle has previously advocated for NHS-wide guidance to prevent similar disputes in the future.

Supported by the Christian Legal Centre (CLC), Peggie expressed that legal action was “regrettable” but necessary to address what she sees as the RCN’s encroaching gender ideology. “I am so very grateful to them and the other witnesses who have generously given their time and assistance to my legal team,” she noted.

Andrea Williams, CLC’s chief executive, stated that nurses should not have to “deny biological reality” and emphasized the importance of fair representation for all members in professional bodies.

An RCN representative stated: “The RCN is an anti-discrimination organisation. We support and represent the rights of all our members and we strive to ensure that all members experience discrimination-free workplaces. We treat our members’ right to confidentiality with the utmost importance and do not comment on individual cases. We are defending the tribunal and are not in a position to comment further.”
