Unprecedented Use of Special Court to Address National Security Concerns
In a historic move, the Justice Department is invoking a rarely used legal mechanism to address national security issues. For the first time, the Alien Terrorist Removal Court is being utilized to potentially deport a woman accused of supporting the Islamic State. This comes as part of a broader strategy to leverage classified evidence against individuals residing in the United States.
The individual in question, Nazira Haji Zada, a lawful permanent resident living in Fort Worth, Texas, is set to face the court in an initial hearing scheduled for Thursday. The court itself was established by Congress in 1996, specifically to enable the Justice Department to handle cases involving classified evidence more effectively.
Despite the court’s existence for over two decades, this marks its inaugural use. The Justice Department initiated proceedings against the 47-year-old Zada earlier this month, marking a significant step in its approach to counterterrorism.
Previously, the authorities had prosecuted Zada’s son and son-in-law. Both men faced charges related to plotting an attack on the 2024 elections in support of the Islamic State. Following their convictions, they received prison sentences and are slated for deportation after serving their time.
Acting Attorney General Todd Blanche emphasized the gravity of the case, stating, “The allegations in this case show the matriarch of an ISIS-sympathizing family aiding in a plot to launch a mass casualty attack on American voters on Election Day.” He further asserted, “The Department’s application in this court makes clear that terrorists have no place in the United States of America.”
Overseeing this pivotal case is Judge Joan Ericksen, the chief judge of the Alien Terrorist Removal Court. Her role will be crucial in determining the outcome of this groundbreaking legal proceeding.
