Supreme Court Maintains Gender-Affirming Care for Transgender Inmates

The ongoing legal battle over transgender rights in federal prisons took a significant turn as the Supreme Court ruled against the Trump administration’s attempt to halt gender-affirming care for transgender inmates. This emergency appeal decision ensures that existing treatment protocols continue, maintaining a lower court’s injunction against a proposed policy change.

The decision, which did not include an explanation, stated, “The application for stay presented to The Chief Justice and by him referred to the Court is denied.” However, Justices Clarence Thomas and Samuel Alito dissented, aligning with the administration’s stance.

In January 2025, President Trump issued an executive order banning federal funding for gender ideology, sparking a class action lawsuit by inmates. The suit argues that this policy infringes upon the Eighth Amendment by constituting cruel and unusual punishment. Earlier rulings by a federal district judge and the U.S. Court of Appeals for the District of Columbia Circuit have blocked the policy’s implementation, prompting the administration’s plea to the Supreme Court.

Li Nowlin-Sohl of the ACLU, representing the inmates, highlighted that over 2,000 transgender individuals are in federal custody. The case, Kingdom v. Trump, involves approximately 1,000 inmates diagnosed with gender dysphoria, with many receiving hormone therapy and other related treatments.

The Trump administration’s request for an emergency stay cited concerns about the risks of providing gender-affirming care, suggesting it could make recipients “targets for attacks” and create fairness issues among inmates. However, the ACLU countered that the Bureau of Prisons has provided such care since 1992, without adverse effects on security or patient health, and that the government’s current arguments seem unfounded.

The Supreme Court’s decision contrasts with other rulings supporting the administration’s policies, such as a previous ruling allowing states to ban transgender girls from participating in school sports. The administration’s agenda has been marked by efforts to restrict gender-affirming care, exemplified by executive orders recognizing only male and female genders.

As the legal landscape continues to evolve, other transgender rights cases await the Supreme Court’s attention. These include disputes over transgender participation in sports and access to state funding for religious preschools that exclude LGBTQ families.
