Trump Administration Moves to Reverse Biden-Era Abortion Policy in VA Hospitals
Recent developments from the Trump administration have sparked reactions from pro-life groups following the decision to revoke a rule established under President Biden. This rule, which had permitted abortions at veterans’ hospitals funded by taxpayer money, is now being reconsidered.
The United States Department of Veterans Affairs (VA), in a proposed rule published Monday, announced intentions to repeal a policy initiated by the Biden administration. This previous policy allowed VA hospitals to perform abortions and offer related counseling in cases such as rape, incest, or medical emergencies faced by the mother.
Initially put in place in 2022, the Biden-era policy came shortly after the U.S. Supreme Court’s decision in Dobbs v. Jackson led several states to enforce strict abortion bans. The rule had enabled VA hospitals in such states to continue providing abortion services under specified conditions.
According to the proposed rule, “We believe the 2022 interim final rule was not only inappropriate as a matter of fact but also was legally questionable. The only time Congress has specifically addressed VA’s authority to provide abortions was in 1992 in section 106 of the Veterans Health Care Act of 1992.” This statement highlights the contention surrounding the legal basis of the policy.
The proposal further outlines that VA’s mandate includes “general reproductive health care” but distinctly excludes “infertility services, abortions, or pregnancy care (including prenatal and delivery care).” However, it clarifies that emergency care for life-threatening conditions like ectopic pregnancies or miscarriages remained part of the VA’s offerings even before the 2022 policy.
“The exclusion for abortion does not apply ‘when a physician certifies that the life of the mother would be endangered if the fetus were carried to term,’” the proposal asserts, emphasizing the ongoing availability of treatments for conditions like ectopic pregnancies without contradicting state laws.
VA Secretary Doug Collins authorized the proposal on July 24. As dictated by federal regulations, there is a 30-day period for public commentary on the proposal, concluding on September 3.
Reacting to the announcement, Marjorie Dannenfelser, President of Susan B. Anthony Pro-Life America, commended the Trump administration’s initiative: “We thank President Trump and VA Secretary Collins for restoring the rule of law and ending the Biden administration’s illegal policy that forced taxpayers to fund abortions through VA hospitals and violated state pro-life laws.”
Similarly, Carol Tobias, President of National Right to Life, lauded the proposed rule. In her statement, she affirmed that the proposal “reflects a return to longstanding policy and a reaffirmation of the department’s mission to provide life-affirming, medically necessary care to our veterans and their families.” Tobias also noted the proposal corrects what she described as an overreach by the previous administration.
