Biden Concedes Legal Battle Over Memoir Tapes, Allowing Their Release
In a surprising turn of events, former President Joe Biden has chosen to halt his legal efforts to prevent the release of conversations recorded with his memoir’s ghostwriter. This decision opens the door for the public dissemination of these recordings, marking a significant victory for the Heritage Foundation, a conservative organization that initiated the lawsuit.
The tapes, dating back to 2017, capture Biden in discussions with his ghostwriter for his book Promise Me, Dad. These recordings became a focal point in a legal battle when, in 2022, Biden reported finding classified documents at his Wilmington residence, prompting an investigation by the Justice Department. The investigation collected the tapes as part of its process.
By 2024, special prosecutor Robert Hur concluded that while Biden had brought classified documents home, criminal charges were unnecessary. The report described the incident as potentially “unremarkable,” given Biden’s extensive exposure to classified materials during his vice-presidency. However, it also controversially portrayed Biden as “a sympathetic, well-meaning, elderly man with a poor memory,” and noted that the tapes highlighted Biden’s struggles with memory.
Conservative activists see the release of these tapes as an opportunity to scrutinize Biden’s mental fitness prior to his presidency. Jeffrey Clark, a Trump ally involved in the lawsuit, stated, “What you’re going to hear on the tapes … is the state of Joe Biden years before he ran for president, when a special prosecutor said he has memory issues.”
Despite the Department of Justice’s initial resistance, arguing that the tapes were akin to a “personal diary,” the legal tide turned in favor of disclosure. Two lower courts, including an appellate court not divided along partisan lines, ruled against Biden’s attempts to block the tapes’ release, leading to his eventual decision to concede.
Biden’s concession contrasts sharply with former President Donald Trump’s ongoing legal battles. While Biden has opted to step back from this litigation, Trump continues to pursue legal challenges vigorously, including a recent attempt to have the Supreme Court revisit a defamation case involving E. Jean Carroll.
The Justice Department has yet to comment on the recent developments. However, a source close to Biden has expressed concern over the implications of releasing private conversations, describing it as a “dangerous” precedent for governmental power.
As the tapes are prepared for public release by the Heritage Foundation, the implications for Biden’s legacy and the broader political landscape remain to be seen.
