In a case that has sparked significant debate, a nurse who faced suspension for refusing to use a transgender patient’s preferred pronouns has reached a settlement with the NHS. Jennifer Melle, a Christian nurse, was suspended for 10 months after the incident involving a trans patient, who was also a convicted paedophile brought in from a male prison.

The Epsom and St Helier University Hospitals NHS Trust had reported Melle to the nursing regulator after she chose not to comply with the patient’s pronoun preference and for publicly discussing her experience. Despite the patient subjecting her to threats and racial abuse, Melle faced suspension and an investigation.

Ultimately, a disciplinary panel cleared Melle of misconduct, allowing her to return to work in February. The Trust agreed to a confidential settlement just before the Croydon Employment Tribunal was set to hear the case.

The Christian Legal Centre (CLC), which supported Melle, indicated that the settlement’s specifics are to remain undisclosed. Meanwhile, the Trust has issued a warning to the patient involved, stating that any further threatening or racially offensive behavior could lead to a ban from its facilities.

Expressing relief over the settlement, Melle remarked, “I look forward to being able to focus on the job I love instead of defending myself against various bizarre accusations.” She also highlighted the importance of her case for medical professionals who should not face challenges for adhering to their conscience and professional duties.

Melle continues to be under investigation by the Nursing and Midwifery Council, a situation she finds alarming for those concerned with fairness and freedom of speech within the NHS.

“I will continue to stand up, not just for myself, but for all nurses who deserve protection and respect,” she asserted.

Andrea Williams, CLC chief executive, described the case as highly concerning, and praised Melle’s courage: “Jennifer has shown remarkable courage. We will stand with her until these remaining injustices are fully resolved.”
